Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy explains how Feedme Hospitality & Restaurant Group (“Feedme,” “we,” “us,” or “our”) collects, uses, and shares “consumer health data” under the Washington My Health My Data Act (the “Act”), and the rights you have in that data. Consumer health data means personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status. This policy addresses only consumer health data; our general Privacy Notice https://www.bardojo.com/privacy-policy describes how we handle other personal information.

1. Consumer health data we collect, and the purpose for which the data is collected

We collect the following categories of consumer health data:

●      Allergy information you provide, such as food allergies or sensitivities.

●      Dietary restrictions, needs, or preferences you provide, including medically restricted diets.

●      Health-related information we reasonably infer from the information above in order to prepare your food safely.

We collect this consumer health data for a single purpose: to accommodate your needs and to safely prepare and provide the reservation, order, private event, or catering service you have requested, and to respond to your related inquiries. We do not use consumer health data for advertising or marketing, and we do not use it to draw any other inferences about you. We do not collect precise location information as consumer health data.

2. Sources of consumer health data

We collect consumer health data directly from you, for example, when you enter it in a reservation, order, event inquiry, or catering form on our websites or on the reservation, ordering, or event-booking platforms we use, or when you provide it to us in person, by phone, or by email.

3. Consumer health data we share

When we share consumer health data, the categories we share are the same categories described in Section 1 (allergy information, dietary information, and related inferences). We share only the specific information needed to fulfill your request.

4. Third parties and affiliates with whom we share consumer health data

Categories of third parties. We share consumer health data, only as needed to fulfill your request, with service providers that operate the reservation, online ordering, and private event or catering systems through which you submit your information.

Specific affiliates. The Act requires us to name the specific affiliates with whom we share consumer health data. The following Concepts of ours share common branding and common control under Feedme and are affiliates under the Act:  Bar Dojo; Salt & Iron; Fire & The Feast; SanKai; Ono Poke; MARKET Seafood Eatery; and Shooby Doo Catering.

5. Consent

Collecting consumer health data that is necessary to provide a product or service you have requested does not require your separate consent under the Act. We collect the consumer health data described in this policy only for that purpose — for example, when you tell us about an allergy so we can prepare your meal or event safely.

We share consumer health data only as necessary to provide the service you requested, or with your separate, opt-in consent. We will not collect additional categories of consumer health data and will not use or share your consumer health data for any purpose not described in this policy, without first updating this policy and obtaining your affirmative, opt-in consent.

We do not sell consumer health data. Because we do not sell it, we do not seek the signed authorization the Act requires for sales.

6. Your rights and how to exercise them

If you are a Washington consumer, or your consumer health data is collected in Washington, you have the following rights:

●      Confirm and access — to confirm whether we are collecting, sharing, or selling your consumer health data, and to access that data, including a list of all third parties and affiliates with whom we have shared or sold it and an active email address or other online mechanism you can use to contact each of them.

●      Withdraw consent — to withdraw your consent to our collection and sharing of your consumer health data.

●      Delete — to have your consumer health data deleted. When you request deletion, we will delete it from our records and notify the affiliates, processors, contractors, and other third parties with whom we have shared it, who are also required to delete it.

●      Appeal — to appeal if we decline to take action on your request.

●      Non-discrimination — we will not discriminate against you for exercising any of these rights.

How to exercise your rights. You may email privacy@feedmehrg.com. We will take steps to verify your identity and will respond within 45 days of receiving your request. Where reasonably necessary, we may extend this period once by an additional 45 days and will notify you.

How to appeal. If we decline to act on your request, you may appeal by emailing privacy@feedmehrg.com. We will respond to your appeal within 45 days and explain our decision in writing. If we deny your appeal, we will provide you with a way to submit a complaint to the Washington State Attorney General.

7. Changes to this policy

We may update this policy. If we intend to collect, use, or share additional categories of consumer health data, or to use or share consumer health data for purposes not described here, we will update this policy and obtain your affirmative consent before doing so. The effective date at the top shows the current version.
